How we manage claims
SRB Legal’s teams use their extensive knowledge, experience and expertise in policy coverage and indemnity and personal injuries to assess each claim. Our teams then work with clients to develop the right strategy and approach to resolve any claim, whether routine or highly complex in nature. Our lawyers are acquainted with all relevant legislation that can apply to these claims, in particular the Occupiers Liability Act and the Civil Liability Act and utilise this knowledge to ensure that available statutory defences and restrictions on damages are relied on where appropriate.
Early resolution is always targeted, however where claims have proved to be incapable of reasonable settlement and where strong defences exist, we then act on behalf of our clients to defend the claim before the courts. We have has successfully defended numerous matters in this way, including claims dealt with in the Magistrates Court, District Court and Supreme Court, as well as appeals to the WA Court of Appeal and, on several occasions, to the High Court.
