SRB Legal’s compulsory third party (CTP) team has over two decades of experience in advising and acting on CTP claims, for both the Insurance Commission of Western Australia (the sole CTP insurer in Western Australia) and for other out-of-state insurers defending WA claims.

SRB Legal has been a member of the Insurance Commission’s specialist catastrophic panel for over a decade and achieves impressive and cost effective outcomes in all types of these claims. We have acted in many of the high value, catastrophic and scheme-sensitive matters in this state in that time.

How we manage claims

Our CTP team adopts a practical, objective, timely and commercial approach to claims management and resolution. We combine well developed systems and processes with expert tactical management of each file to successfully resolve claims and deliver superior outcomes for our clients.

We use a range of resources to achieve these results. In many cases, we take specialist advice from our firm’s in-house counsel and advocate on issues around indemnity, liability, quantum assessment, contribution, and recovery opportunities, as well as preparation of pleadings and representation at interlocutory hearings if necessary.

Our CTP team uses specialised online technology and a separate database to record and organise complex processes such as discovery and the management of multiple claimant matters and high volumes of documentation. Our team also use purpose-built spreadsheets for the cost effective calculation of damages.

Where required, we engage various experts to help identify and calculate the many expenses relating to ongoing medical and personal care needs, for example occupational therapists and neuropsychologists.

At the same time, our CTP team is adept at skilfully managing overlapping issues of privilege, public interest immunity, confidentiality and privacy concerns, to produce the best result without compromising highly sensitive matters.
